Locunity, Inc., a Delaware corporation with its principal place of business at 2261 Market Street, STE. 68363, San Francisco, CA 94114 (“Locunity,” “we,” “us,” or “our”), respects your privacy. This Privacy Policy describes how we collect, use, disclose, and retain personal information when you visit www.locunity.com or any other Locunity website that links to this Policy (the “Site”), use our civic intelligence platform, dashboards, alerts, and APIs (the “Platform”), subscribe to or read our newsletters, briefings, and other editorial content (the “Content”), communicate with us, or otherwise interact with us (collectively, the “Services”).
This Policy is incorporated into and forms part of our Terms of Service, available at www.locunity.com/terms. If you use the Services through a seat provisioned by your employer or another organization under a written agreement with Locunity, Section 14 (Enterprise Accounts) also applies, and that agreement controls with respect to your organization’s data. By using the Services, you acknowledge the practices described in this Policy.
2.1 Information You Provide.
2.2 Information Collected Automatically. When you use the Services, we and our service providers automatically collect device and usage information, including IP address, browser type, operating system, device identifiers, pages viewed, features used, links clicked, referring URLs, and date/time stamps, along with approximate (city-level) location inferred from IP address. Our emails may contain pixels and tracked links that tell us whether a message was opened and which links were clicked. See Section 4 (Cookies and Tracking Technologies).
2.3 Information from Other Sources.
We use personal information to:
We do not use the contents of enterprise customers’ confidential data to train generalized artificial intelligence models, except on an aggregated and de-identified basis or as otherwise permitted by the applicable written agreement.
We and our service providers use cookies, pixels, local storage, and similar technologies to operate the Services. These include: strictly necessary technologies required for log-in, security, and core functionality; functional technologies that remember your settings and preferences; and analytics technologies that help us understand how the Services are used so we can improve them. We do not currently use third-party advertising cookies or engage in cross-context behavioral advertising; if that changes, we will update this Policy and provide any legally required opt-out mechanisms.
You can control cookies through your browser settings, and you can limit email pixel tracking by disabling image loading in your email client, though some features may not function properly without certain technologies. Because there is no uniform industry standard, we do not respond to browser “Do Not Track” signals; however, we treat opt-out preference signals such as the Global Privacy Control (GPC) as a request to opt out of any sale or sharing of personal information to the extent required by applicable law, as described in Section 8.
We do not sell personal information for money, and we do not share personal information with third parties for cross-context behavioral advertising. We disclose personal information only as follows:
Text messaging. No mobile phone numbers or text messaging originator opt-in data and consent will be sold or shared with third parties or affiliates for marketing or promotional purposes. Text messaging opt-in data and consent are shared only with service providers that assist us in delivering messages, and only for that purpose.
Locunity is a civic news and information service. Our Content reports on, quotes, summarizes, and links to public proceedings and Public Records, which necessarily include personal information about individuals who hold public office, work for public agencies, or participate in public meetings, including speakers during public comment.
We process this information for journalistic, editorial, and public-interest purposes. Applicable privacy laws, including the California Consumer Privacy Act, contain exemptions for publicly available information and for noncommercial activities protected by the free press guarantees of the U.S. and California Constitutions. Accordingly, privacy rights requests described in this Policy generally do not extend to removing or altering references to individuals in our news coverage, editorial archives, or the underlying Public Records, which we may retain indefinitely as part of the journalistic and historical record. If you believe our Content contains a factual error about you, please contact Support [at] Locunity [dot] com and we will review it under the corrections process described in our Terms of Service.
This Section applies to California residents and supplements the rest of this Policy. We honor the rights described below for all California residents, whether or not the California Consumer Privacy Act, as amended (the “CCPA”), applies to us as a covered “business” at any given time.
8.1 Categories Collected. In the preceding twelve (12) months, we have collected the following categories of personal information, from the sources and for the purposes described in Sections 2 and 3: identifiers (such as name, email address, phone number, IP address, and account identifiers); customer records information (such as billing information); commercial information (such as subscriptions and transaction history); internet or other electronic network activity information (such as usage data and email engagement); approximate geolocation derived from IP address; audio information (recorded calls, with notice); professional or employment-related information (such as organization and job title); and inferences drawn from the foregoing (such as coverage preferences). We disclose these categories to the recipients described in Section 5 for business purposes. We collect sensitive personal information only in the form of account log-in credentials, which we use solely to provide and secure the Services; we do not use or disclose sensitive personal information for purposes that would trigger a right to limit under the CCPA.
8.2 No Sale or Sharing. We do not sell personal information, and we do not share personal information for cross-context behavioral advertising, including of consumers under sixteen (16) years of age. To the extent required by law, we treat Global Privacy Control signals as a valid request to opt out of sale or sharing for that browser or device.
8.3 Your Rights. Subject to the exemptions described in Section 6 and other legal exceptions, California residents have the right to: (a) know and access the personal information we have collected about them, including the categories collected, sources, purposes, and recipients; (b) delete personal information we collected from them; (c) correct inaccurate personal information; (d) opt out of any sale or sharing of personal information; and (e) not receive discriminatory treatment for exercising these rights.
8.4 Submitting Requests. You or your authorized agent may submit a request by emailing Support [at] Locunity [dot] com or by writing to Locunity, Inc., Attn: Privacy, 2261 Market Street, STE. 68363, San Francisco, CA 94114. We will verify your request using the email address associated with your account and, where necessary, additional account information; authorized agents must provide proof of authorization, and we may require you to verify your identity directly. We will respond within the timeframes required by law (generally forty-five (45) days, extendable once by an additional forty-five (45) days with notice).
8.5 Shine the Light. Under California Civil Code Section 1798.83, California residents may request information about disclosures of personal information to third parties for those parties’ direct marketing purposes. We do not disclose personal information to third parties for their own direct marketing purposes.
Residents of other states with comprehensive privacy laws (including Colorado, Connecticut, Oregon, Texas, and Virginia) may have similar rights to access, correct, delete, and obtain a portable copy of their personal information, and to opt out of targeted advertising, sales, and certain profiling. We do not sell personal information or process it for targeted advertising or for profiling in furtherance of decisions producing legal or similarly significant effects. You may submit requests using the methods in Section 8.4. If we decline to act on your request, you may appeal by replying to our response with the word “Appeal,” and we will review the appeal and respond as required by applicable law. Nevada residents may submit opt-out requests regarding any future sale of covered information, as defined by Nevada law, to Support [at] Locunity [dot] com.
Locunity operates the Services from the United States, and personal information is processed and stored in the United States, where privacy protections may differ from those in your jurisdiction. If you access the Services from the European Economic Area, the United Kingdom, or Switzerland, our legal bases for processing are: performance of a contract (providing the Services you request); our legitimate interests (operating, securing, and improving a news and information service, and communicating with users); your consent (for marketing communications and where otherwise required); and compliance with legal obligations. Subject to the journalistic and public-interest considerations described in Section 6, you may have rights of access, rectification, erasure, restriction, portability, and objection, which you may exercise using the methods in Section 8.4, and you may lodge a complaint with your local supervisory authority.
We retain personal information for as long as reasonably necessary for the purposes described in this Policy, including to provide the Services, comply with legal, tax, and accounting obligations, resolve disputes, and enforce agreements. In general: account information is retained for the life of the account and a reasonable period thereafter; billing records are retained as required by law; call recordings are retained for a limited period; and usage logs are retained on a rolling basis. Editorial content and archives, including references to individuals appearing in Public Records, may be retained indefinitely as part of the journalistic and historical record, as described in Section 6. In deciding retention periods, we consider the amount and sensitivity of the information, the potential risk of harm from unauthorized use or disclosure, and applicable legal requirements.
We maintain administrative, technical, and physical safeguards designed to protect personal information appropriate to its nature and the risks involved, including access controls, encryption in transit, and vendor due diligence. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security. If a breach affecting your personal information occurs, we will notify you and applicable regulators as required by law. You are responsible for maintaining the confidentiality of your account credentials.
The Services are not directed to children under thirteen (13), and we do not knowingly collect personal information from children under 13. If you believe a child under 13 has provided us personal information, contact Support [at] Locunity [dot] com and we will delete it as required by law. This Section does not apply to information about minors that appears in Public Records or news coverage, which is addressed in Section 6.
If you use the Services through a seat provisioned by an organization under an enterprise agreement with Locunity: (a) your organization controls its subscription, including adding and removing authorized users; (b) your organization’s administrators may access information described in Section 5; and (c) we process data submitted by your organization (“Client Data”) as a service provider on your organization’s behalf, in accordance with the applicable written agreement, which controls over this Policy with respect to Client Data. Direct questions about your organization’s policies to your administrator.
The Services link to and interoperate with third-party websites and services, including government websites hosting Public Records, payment processors, and tools you choose to connect. This Policy does not apply to third parties, and we are not responsible for their privacy practices. We encourage you to review the privacy policies of any third-party sites and services you use.
We may update this Policy from time to time. The “Last Updated” date above reflects the most recent version. If we make material changes, we will provide reasonable advance notice, such as by email or a notice within the Services, before the changes take effect. Your continued use of the Services after the effective date constitutes acknowledgment of the updated Policy.
